Terms of Use
- General
1.1 Provider and scope
Senioris24 UG, represented by its managing director, Europaring 61, 53123 Bonn (hereinafter referred to as "Senioris"), operates an online platform (www.senioris24.com) for connecting self-employed caregivers with clients for 24-hour in-home care (household support and social care, excluding medical treatment). Senioris offers nationwide placement services for self-employed caregivers (hereinafter referred to as "caregivers") for in-home care and support. Senioris assists prospective clients (hereinafter referred to as "clients") in finding and selecting a suitable caregiver for themselves, their relatives, or other close persons (relatives and other close persons are hereinafter referred to as "clients") and supports them in communicating with the caregiver, facilitating the conclusion of an individual care agreement between the prospective client/client and the caregiver (hereinafter referred to as the "care agreement"). Senioris also provides a platform for caregivers to offer their services, connect with suitable clients or their employers, and conclude a care agreement. These terms of use govern the relationship between Senioris and the users of the website.
Users within the meaning of these terms and conditions include, in particular, prospective care recipients, relatives or other clients, self-employed caregivers, and sending agencies.
1.2 Role of the intermediary
Senioris provides placement services exclusively. Specifically, Senioris is not the employer of the caregivers, no temporary staffing as defined by the German Temporary Employment Act (AÜG) takes place, Senioris is not a party to the service agreement between the client and the caregiver or the sending agency, and Senioris has no authority to give instructions to the caregiver. A service agreement is concluded exclusively between the client and the self-employed caregiver or the sending agency.
1.3 Changes to the Terms of Use
Senioris reserves the right to amend or supplement these Terms of Use with future effect, insofar as this is necessary due to legal changes or organizational adjustments. Users will be notified of any changes in an appropriate manner. Specifically, this means:
1.3.1 Information about changes to users
Changes or additions to the terms of use will be announced to the user by email in good time before they are intended to come into effect, usually no later than 14 days before they become effective.
Senioris is not obligated to send the amended or supplemented provisions individually or the complete revised Terms of Use separately. Notification of the nature and scope of the changes or additions is sufficient. The announcement will include a link where the current version of the Terms of Use can be viewed in full.
1.3.2 Right of objection and deemed consent
The user has the right to object to the announced changes or additions within 30 days of receiving the notification of changes in written form. If the user does not object within this period and continues to use the services after the objection period has expired, this will be considered acceptance of the announced changes or additions.
Senioris will explicitly inform the user in the notification of changes about the objection period, the legal consequences of failing to object, and the requirement of written form. In the event of a timely objection, Senioris is entitled to terminate the contractual relationship with due notice at the earliest possible date.
1.3.3 Special regulations for caregivers
Notwithstanding the above provisions, caregivers will be informed of any changes or additions to the terms of use specifically and completely on a durable medium as defined in Section 126b of the German Civil Code (BGB). The notification will contain the complete revised version of the amended terms of use or a comprehensible comparison of the changes. Deemed consent applies to caregivers only to the extent that it is legally permissible and has been expressly agreed upon.
- Use of the website and conclusion of the contract
2.1 Non-binding use and registration
The use of the website for informational purposes is free of charge and without obligation.
Submitting a contact form or inquiry does not constitute a contract. Use of the platform's services requires user registration. This requires providing the user's first and last name, as well as a valid email address or mobile phone number. The email address or mobile phone number is also used for communication with Senioris. After providing the required registration information, the user will receive an email to confirm their registration and complete their registration based on the previously accepted terms of use.
After successful registration, the user receives a registration confirmation from Senioris. Users can create a user account on the platform. This requires an email address or, optionally, a telephone number and a password (hereinafter: "login data"). The user is obligated to handle their login data with care. In particular, the user is prohibited from disclosing their login data to third parties and/or enabling third parties to access the user account by circumventing the login data. Should the user breach this obligation and their user account be used by third parties, the user is liable for all activities that take place using their user account. The user is not liable if they are not responsible for the misuse of their user account.
2.2 Conclusion of contract and contract content
2.2.1 Conclusion of the user agreement
Upon completion of the online registration process and creation of a user account, a contract for the use of the platform (hereinafter referred to as the "User Agreement") is concluded between the respective user and Senioris. Prior acceptance of the applicable Terms of Use is a prerequisite for the conclusion of this agreement.
2.2.2 Subject matter of the user agreement
The subject of this user agreement is the provision and use of the platform to the extent described in these terms of use. This user agreement establishes exclusively rights and obligations between Senioris and the respective user with regard to the use of the platform.
- User agreement with prospective care recipients
The user agreement with prospective caregivers includes in particular the technical provision of the platform, support in finding a suitable caregiver, support in making contact, and support in concluding an individual care agreement.
2.2.3.1 Needs analysis and user profile
To prepare for the placement, a structured needs assessment is first conducted using a questionnaire ("needs analysis"). Based on the information provided during the needs analysis, a user profile is created, which is visible to other users of the platform.
2.2.3.2 Placement proposals by Senioris
Based on the needs analysis, Senioris can suggest suitable caregivers to the person interested in care..The person seeking care decides independently whether to contact a caregiver and enter into a care agreement with them. If an agreement is reached, the care agreement can be concluded directly via the platform.
2.2.3.3 Independent selection by prospective caregivers
Regardless of suggestions from Senioris, those seeking care can independently select and contact suitable caregivers based on the published profiles. If an agreement is reached, the care agreement is concluded directly between the parties via the platform.
2.2.3.4 Selection by caregivers
Those interested in care can also be contacted by caregivers based on their profile. If an agreement is reached, the care agreement is also concluded directly between the parties via the platform.
2.2.3.5 Supportive accompaniment
Senioris supports prospective caregivers in communicating with caregivers and with organizational issues during the care relationship and in connection with its termination.
2.2.3.6 Legal classification of the care agreement
The care agreement is concluded exclusively between the person seeking care or their client and the respective caregiver. It is legally independent and separate from the user agreement with Senioris. Senioris is neither a party to the care agreement nor a representative, agent, or other party involved in the care relationship. Any contractual rights and obligations arise exclusively between the directly involved parties.
- Usage agreement with caregivers
The user agreement with the caregiver includes the technical provision of the platform, support in finding suitable care applicants, support in making contact, and support in concluding individual care agreements.
2.2.4.1 Service provider profile
To showcase the caregiver's qualifications and availability, a service provider profile is created. The information provided is published in a profile visible to other users.
2.2.4.2 Independent selection of prospective caregivers
The caregiver can independently select and contact suitable prospective clients based on the profiles. If an agreement is reached, the care agreement is concluded directly between the parties via the platform.
2.2.4.3 Contact by prospective caregivers
Caregivers can be contacted by prospective clients based on their profiles. If an agreement is reached, the care agreement is also concluded directly between the parties.
2.2.4.4 Supportive accompaniment
Senioris supports caregivers in communicating with prospective care recipients and in organizational matters during the care relationship and in connection with its termination.
2.2.4.5 No obligation to perform arises from the user agreement
The user agreement with Senioris does not obligate the caregiver to accept a care assignment. A service obligation arises solely upon conclusion of an individual care agreement between the caregiver and the respective prospective care recipient or client. This care agreement is legally independent of the user agreement with Senioris. Senioris is neither a contracting party nor an agent or vicarious agent of either party in the care relationship.
2.2.5 Tax Responsibility
Insofar as remuneration claims arise between caregiver and prospective care recipient or client, the respective parties are independently responsible for the proper tax treatment and taxation.
- Brokerage agreement
A binding brokerage agreement only comes into effect through the signing of a separate brokerage agreement or express written confirmation by the broker.

- Use of the platform and obligations to cooperate
3.1 Usage options
3.1.1 Authorization to use
After complete registration, providing the data requested by Senioris, and expressly agreeing to these terms of use, the user is entitled to use the platform to the extent contractually agreed. Use of all functions requires continued acceptance of the terms of use.
3.1.2 Posting your own content
Users are entitled to post and publish their own content, such as personal information, texts or images, on the platform, provided that this content complies with the terms of use.
3.1.3 Contact between users
Caregivers can view the profiles of prospective clients and their clients. Likewise, prospective clients can view the profiles of caregivers. Based on this information, users can independently make contact and conclude an individual care agreement.
3.1.4 Display and Matching Logic
The order in which caregivers are displayed is determined by a comparison between the needs analysis and the service provider profile. The following criteria are particularly important in this process: information about the person requiring care and their environment, their health and mental state, individual needs and preferences, and the caregiver's qualifications and availability. Senioris bases its approach on experience showing that these parameters are crucial for a successful care relationship. The specific weighting of the individual factors is protected by trade secrets.
3.1.5 Evaluation system
Once a care relationship has been established, both parties can submit ratings and supplementary comments. These will be published and assigned to the respective user profile.
3.1.6 Removal or blocking of content
Senioris reserves the right to remove content or block access if there is evidence of legal violations or infringements of third-party rights. Where possible and reasonable, the affected user will be given the opportunity to comment or remedy the situation beforehand.
- Technical availability
Senioris strives to ensure the most uninterrupted availability possible. However, there is no guarantee of uninterrupted availability at all times. Access or usage restrictions may occur, in particular, due to maintenance work, technical or capacity requirements, violations of terms of use, lack of suitability or reliability, failure to fulfill a support agreement, or circumstances beyond Senioris' control. Such restrictions may be temporary or permanent.
3.1.8 Further development of the platform
Senioris is entitled to adapt, expand or discontinue functions, provided that this does not eliminate any essential contractual obligations.
3.2 Obligations to cooperate
- Technical Integrity
The user agrees to refrain from any action that could impair the operation or technical infrastructure of the platform. In particular, the following are prohibited: the use of automated programs (bots, scripts, etc.), the unauthorized reading, copying, or modification of data, the circumvention of technical security measures, and excessive system load.
3.2.2 Reporting of malfunctions
Technical malfunctions must be reported to Senioris immediately.
- Unauthorized uses
4.1 General Prohibition
It is prohibited to use the platform for unlawful, immoral or third-party infringing purposes or to post such content.
- Inadmissible orders
Specifically prohibited are activities with an erotic or pornographic connotation, services that violate labor, youth or data protection regulations, and violations of the Act to Combat Undeclared Work (SchwarzArbG)..
- Other prohibited acts
Also prohibited are the distribution of harmful software, unauthorized access to secured data, spam or chain messages, discriminatory, violence-glorifying or defamatory content, and unauthorized public reproduction of platform content.
4.4 Reporting obligation
Senioris must be notified immediately of any unlawful or abusive use.
4.5 Measures in case of suspicion
In case of suspected unlawful activity, Senioris is entitled and, where appropriate, obligated to investigate the facts and take necessary legal action, including notification to law enforcement authorities.
- Usage rights to content
5.1 Granting of rights
By posting content, the user grants Senioris a transferable, non-exclusive and free right of use that is unlimited in time, space and subject matter.
This includes, in particular, the right to reproduce, distribute and make publicly available.
5.2 Waiver of attribution
To the extent permitted by law, the user waives the right to be named as the author.
5.3 Rights to platform content
All rights to the platform itself and to content provided by Senioris remain with Senioris. Redistribution or public reproduction without permission is prohibited.
- Remuneration
- Prospective care recipients
Registration is initially free. Upon conclusion of a care agreement, the contractually agreed care costs, insurance and administration fees, and service fees (calculated as a percentage of the care fee) will apply. In the event of early termination, a separately itemized daily platform usage fee will be charged for the remaining minimum term. If several proposed caregivers are rejected or there is prolonged inactivity, Senioris may switch the pricing model to "emergency care."
6.2 Caregivers
Fees only become payable upon conclusion of a care agreement in accordance with the conditions shown on the platform.
- Term and termination
Service agreements with prospective care recipients have a minimum term depending on the pricing model and are automatically renewed unless terminated with due notice. Service agreements with caregivers are generally open-ended. The right to extraordinary termination for good cause remains unaffected. Terminations can be made in writing or electronically.

- Right of withdrawal (consumer)
Consumers may cancel the user agreement within 14 days. Cancellation must be sent to Senioris UG, Europaring 61, 53123 Bonn, Germany, or by email to [email address missing]. Compensation is payable for services already rendered if they commence prematurely. The right of cancellation expires upon full performance of the contract and with the consumer's explicit consent.

- Liability
Senioris is liable without limitation for intent, gross negligence, and personal injury. In cases of slight negligence, Senioris is only liable for breaches of essential contractual obligations and only for foreseeable damages. In particular, no liability exists for inaccurate information provided by users, the performance of care services, damages between caregivers and prospective care recipients, or cancellations due to non-attendance of care.
